Terms of Service

1. Scope

These Terms govern your use of our website and the supply of products including support materials, engineered filaments, and hardened nozzles (the “Products”). By placing an order or requesting samples, you agree to these Terms.

2. Quotes and Orders

• Quotes are valid for the period stated or 30 days by default.
• Orders are subject to acceptance and stock or capacity availability.
• Minimum order quantities and lead times are indicated on quotes.
• We may require upfront payment or deposits for custom runs.

3. Prices and Payment

All prices are in MYR unless stated otherwise. Taxes, duties, and shipping are additional where applicable. Payment terms are specified in each invoice; late payments may attract finance charges permitted by law. Title to goods transfers upon full payment.

4. Delivery and Risk

Risk passes to you upon delivery to your carrier or to the delivery address provided. Delivery dates are estimates. We are not liable for delays caused by courier disruptions, customs, or events beyond our reasonable control.

5. Specifications and Samples

Product specifications, tolerances, and test results are based on batch averages. Samples and trial data are indicative. You are responsible for verifying suitability for your equipment, environmental conditions, and end‑use applications.

6. Warranties

• We warrant that Products will materially conform to the specifications provided at shipment.
• If a Product is defective, notify us within 14 days of receipt. Our sole obligation is, at our option, replacement or refund of the affected items upon return or evidence of defect.
• This warranty excludes misuse, improper storage (including moisture exposure), wear from abrasive filaments on standard nozzles, and modifications.

7. Returns

Returns require prior authorisation and a valid RMA. Custom or made‑to‑order items may not be returnable except for verified defects. Shipping costs for returns are your responsibility unless otherwise agreed.

8. Limitation of Liability

To the maximum extent permitted by law, Incubuyemo is not liable for indirect, incidental, or consequential damages, including lost production or profits. Our aggregate liability for any claim is limited to the amount paid for the Products giving rise to the claim.

9. Compliance and Use

You are responsible for ensuring Products comply with your industry requirements and local regulations when used in tooling, jigs, fixtures, or end‑use parts. Do not use Products in safety‑critical systems unless validated independently.

10. Intellectual Property

We retain all rights in our trademarks, documentation, and proprietary formulations. Providing drawings or specifications does not transfer your IP to us, and producing parts to your drawings does not transfer our process know‑how to you.

11. Confidentiality

Both parties will keep confidential information received in connection with quotes, trials, or orders confidential and use it only for the purpose of the engagement, except where disclosure is required by law.

12. Data Protection

We process personal data in accordance with our Privacy Notice. By engaging with us, you acknowledge that certain processing is necessary to provide the Products and support.

13. Force Majeure

Neither party is liable for failure to perform due to causes beyond reasonable control, including natural disasters, acts of government, supply chain disruptions, or labour disputes. Performance will resume promptly when the event ends.

14. Governing Law

These Terms are governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.
